Protecting Your Rights & Outlining Our Responsibilities

Welcome to BK Consultancy & Training (“BK”, “we”, “us” or “our”). These Terms and Conditions (“Terms”) govern your access to and use of our website (https://www.bkhebra.com) and the training services, courses, and related materials provided by BK Consultancy & Training (collectively, the “Services”). By accessing or using our website or enrolling in any of our courses, you agree to be bound by these Terms. If you do not agree with these Terms, please do not use our website or register for our Services.


1. Agreement and Acceptance

  • Binding Agreement: By using our website or registering for our training Services, you (“Customer” or “you”) acknowledge that you have read, understood, and agree to be bound by these Terms.

  • Electronic Acceptance: Your continued use of the website and Services, including the online booking process, constitutes your acceptance of these Terms.


2. Definitions

For the purposes of these Terms:

  • “Training Services” means the courses, training programs, workshops, seminars, and other related educational services provided by BK Consultancy & Training.

  • “Training Materials” refers to any documents, presentations, handouts, recordings, and other educational content provided as part of the training.

  • “Delegate(s)” means the individual(s) nominated by the Customer to attend the training courses.

  • “Website” refers to https://www.bkhebra.com and any related subdomains.

  • “Customer Data” means any information, including personal information, submitted by you in connection with the registration and provision of the Training Services.

  • “Contract” means any agreement formed between BK and the Customer in relation to the provision of the Training Services.


3. Training Services

  • Scope of Services: BK provides training and consultancy services in areas including (but not limited to) asset management, maintenance and reliability, project management, risk assessment, and related fields.

  • Course Content: While we strive to provide accurate and up-to-date training content, BK reserves the right to modify or update course content at any time without prior notice.

  • Delivery Methods: Training may be delivered in various formats including in-person, online, or a combination thereof. Specific delivery details will be communicated at the time of registration.


4. Registration and Booking

  • Online Booking: Customers must complete the online registration process available on our website to enroll in any course. All details provided must be accurate and up-to-date.

  • Confirmation: Enrollment is subject to confirmation by BK. Once confirmed, your participation in the training course is guaranteed for the specified date(s).


5. Fees, Payment, and Refunds

  • Fees: The training fees (“Charges”) for each course are specified on the relevant course page or in the Contract. Fees are calculated per session and per Delegate unless otherwise stated.

  • Payment Terms: Payment must be made in full by the due date as indicated during registration or on the invoice. For online bookings, payment is processed immediately through our secure payment gateway.

  • Taxes: All Charges are exclusive of any applicable taxes, which will be added as required by law.

  • Refunds and Cancellation:

    • For Public Training sessions, cancellations must be submitted in writing at least 30 calendar days before the course start date.

    • For In-House Training provided at the Customer’s premises, cancellations require at least 45 calendar days’ notice.

    • Training that is non-classroom based may be non-refundable.

    • If you cancel in accordance with these Terms, any approved refund will be processed via the original mode of payment. BK reserves the right to withhold certification if payment is not received.


6. Cancellation and Rescheduling

  • Customer-Initiated Cancellation: Cancellations must be made in writing to our designated contact email (contact@bkhebra.com). Cancellations received after the specified notice period may incur a cancellation fee or no refund.

  • BK-Initiated Cancellation: BK reserves the right to cancel or reschedule training sessions at any time due to unforeseen circumstances. In such cases, BK will offer alternative dates, a full refund, or a credit note at our discretion.


7. Intellectual Property Rights

  • Ownership: All intellectual property rights in the Training Materials and course content are owned by BK Consultancy & Training.

  • Restrictions: You are granted a limited, non-exclusive license to use the Training Materials for your personal or in-house educational purposes only. No part of these materials may be reproduced, distributed, or transmitted in any form without the prior written consent of BK.


8. Confidentiality and Data Protection

  • Confidential Information: Both parties agree to maintain the confidentiality of any confidential information disclosed during the provision of the Training Services.

  • Data Privacy: BK will process Customer Data in accordance with applicable data protection legislation. Please refer to our Privacy Policy for more details on how we collect, use, and protect your personal data.

  • Security: We employ reasonable security measures to protect your data; however, BK is not liable for any unauthorized access or data breaches beyond our control.


9. Limitation of Liability

  • General Disclaimer: BK shall not be liable for any indirect, incidental, consequential, or special damages arising out of or in connection with the use of our Services.

  • Aggregate Liability: In any event, BK’s total aggregate liability shall be limited to the amount paid by the Customer for the specific Training Services in question.

  • Exclusions: Nothing in these Terms shall limit BK’s liability for death or personal injury caused by negligence, fraud, or any liability that cannot legally be excluded.


10. Dispute Resolution and Governing Law

  • Dispute Resolution: In the event of any dispute arising out of these Terms, the parties agree to attempt to resolve the matter amicably through negotiation. If unresolved, disputes shall be submitted to mediation or arbitration before pursuing legal action.

  • Governing Law: These Terms shall be governed by and construed in accordance with the laws of [Insert Applicable Jurisdiction]. Any legal action shall be brought exclusively in the courts of that jurisdiction.


11. Amendments and Modifications

  • Right to Amend: BK reserves the right to amend these Terms at any time. Any changes will be posted on our website and become effective immediately upon posting.

  • Continued Use: Your continued use of the website or our Services after any amendments constitutes your acceptance of the revised Terms.


12. Miscellaneous

  • No Partnership or Agency: Nothing in these Terms creates a partnership, joint venture, or agency relationship between BK and the Customer.

  • Assignment: You may not assign or transfer these Terms without our prior written consent. BK may assign or transfer these Terms at its discretion.

  • Entire Agreement: These Terms, together with any documents expressly incorporated herein, constitute the entire agreement between you and BK regarding the use of our Services.
